1. TERMS OF SERVICE AND ACCEPTABLE USE POLICY
E-mail: Sending unsolicited mail messages, including, without limitation, bulk emailing, opt-in-lists, double opt-in-lists, commercial advertising and informational announcements, is explicitly prohibited. A user may not include National Web Design or any of its gateway URL’s in any part of an e-mail unless the recipient has given you as a member of National Web Design direct permission to receive such information. Direct permission implies that each email mail recipient contacted you directly, and that the email recipients窶 were not purchased through a third party source where the recipients approval cannot be directly verified.

Sending unsolicited e-mails of any type is considered ‘SPAM’ and is strictly prohibited. Any acts of 窶彜pam窶 or unsolicited emails will result in immediate suspension and possible termination of your account with National Web Design.

2. Grounds for Suspension and Termination: As a National Web Design member, you agree to comply with these Terms and Policies. Any violation of either of these Terms and Policies may serve as cause for National Web Design to suspend or terminate your account. You agree that National Web Design, Inc. has the right, with or without notice, to suspend or terminate your account upon the first or subsequent occurrence of any of the following:

a. Using the Service in a way, which constitutes violation of any copyright, trademark, applicable statute, law, court order, tariff, regulation, or treaty (including, but not limited to, intellectual property, communications, privacy, criminal and international law).

b. Using the Service in a manner intended to abuse or to violate the privacy or property rights of others, including but not limited to sending of unsolicited bulk e-mail (“spamming窶). Using the service to store, transfer, or advertise the following: pornography, nudity, violations of privacy, computer viruses, hacking, “warez”, and any harassing and/or harmful material or uses.

c. Using the Service to add or attempt to add addresses to any mailing list (yours or a third party’s) without the explicit positive consent of the addressee(s).

3. Liability. You agree to be liable for any damages or loss of service, which result in damages to National Web Design as a result of any spamming or other violations of the sections above (1,2). These damages include, but are not limited to, system shut downs, retaliatory attacks or data flooding, and loss of peering arrangements. You agree that National Web Design may pursue any such claims against you in District Court in Maricopa, Arizona.

Furthermore, National Web Design aggregate liability arising under or with respect to this Agreement shall in no event exceed the total membership fee paid by the customer.

4. Term and Termination: This Agreement will remain in effect for as long as National Web Design makes the Service available, unless the Agreement is terminated due to breach of its terms. National Web Design has the right to terminate this Agreement at any time by notifying the other party in writing.

5. No Promise Of Earnings: Every effort has been made to accurately represent the product and it窶冱 potential. There isnoguarantee that you will earn any money using the techniques and ideas in this package or on our Website. Examples in this package and on our Website are not to be interpreted as a promise or guarantee of earnings. Earning potential is entirely based upon the person using our product, ideas and techniques. We do not purport this as a 窶徃et rich quick窶 scheme. Your level of success in attaining the results claimed in our materials depends on the time you devote to the program, ideas and techniques mentioned, your finances, knowledge and various skills. Since these factors differ according to individuals, we cannot guarantee your success or income level nor are we responsible for any of your actions.

6. Limitation Of Damages:National Web Design shall have no liability for any indirect, incidental or consequential damages, or any loss of revenue arising under or with respect to this agreement or the Customer programs, even if National Web Design has been advised of the possibility of such damages. Furthermore, National Web Design aggregate liability arising under or with respect to this Agreement shall in no event exceed the total membership fee paid by the customer.

7. Copyrights: Customer is responsible for ensuring that Customer’s advertising obeys all applicable copyright and trademark laws. National Web Design is not responsible for Customer’s misuse of any copyrighted material.

8. Service Interruption and Tracking: National Web Design will make every effort to ensure that its Website is operational. However, certain unavoidable technical difficulties may occasionally cause temporary service and tracking interruptions. Customer agrees that National Web Design is not liable in any way for such interruptions.

9. Miscellaneous: Customer is an independent contractor, and nothing in this Agreement shall create any form of partnership, joint venture, franchise, agency, or employment relationship between the parties. Customer will not be treated as an employee with respect to the Internal Revenue Code, Social Security Act, Federal Unemployment Acts, or any other federal, state, or local statute, ordinance, rule, or regulation. Customer shall not assign this Agreement, by operation of law or otherwise, without the prior express written consent of National Web Design. Subject to the foregoing, this Agreement is binding upon, insures to the benefit of, and is enforceable by the parties and their respective successors and assigns. Customer may not sell or transfer their websites for any reason.

10. Copyrights: Customer is responsible for ensuring that Customer’s advertising obeys all applicable copyright and trademark laws. National Web Design is not responsible for Customer’s misuse of any copyrighted material.

11. Agreement Modification: National Web Design reserves the right to change any of these terms and conditions, at any time and at its sole discretion, by posting a new Agreement on the National Web Design web site and notifying Customer via email.

12. Law and Forum:This Agreement shall be deemed entered into in the State of Arizona and shall be construed in accordance with the laws of the State of Arizona and of the United States. The Parties stipulate that the proper forum, venue and court for any legal action taken with regard to this Agreement shall be held in the appropriate Court for the City and County of Maricopa or in the United States District Court for the District of Arizona.

13. Refund Policy: Any purchase has 14 days from the date of purchase to rescind this Agreement. After 14 days from the date of purchase all sales are considered final and are non refundable. All requests for refunds must be submitted in writing either via certified mail or by submitting a request to customersupport@nationalwebdesign.org

The failure of either party to exercise any right or remedy provided for herein shall not be deemed a waiver of any right or remedy hereunder.
